Delhi's Dwarka court on Saturday took cognisance of the charge sheet filed in the murder case of Tarun from Uttam Nagar. The court took cognisance against 17 accused and declined to take cognisance against one accused, Imran alias Bunty.
Delhi police had filed a charge sheet in the Tarun muder case, which took place in Uttam Nagar on Holi on March 4 this year. Sections related to offences against a person of the SC-ST community and murder. A chargesheet was filed against 18 persons in the Dwarka court. In this case, two accsued are absconding. Two minors are also made accsued whose matter will be heard by the Juvenile Justice Board. Additional Sessions Judge (SC-ST Act) Shivali Bansal took cognisance of the charge sheet against the listed matter for scrutiny of documents on June 6. "I have gone through the charge-sheet, and there is sufficient material on record to proceed against all the accused persons," ASJ Bansal said in the order of May 22. The court has issued a production warrant for all accused persons. They will be produced through video conferencing from Judicial custody. During the hearing, the court declined to take cognisance against Imran alias Bunty. The court has ordered his release from custody. The investigation officer (IO) has submitted that the accused Imran alias Bunty was arrested mistakenly, and he has no involvement in the present case. Additional Public Prosecutor (APP) for the State submitted that there is nothing on record against Imran alias Bunty, and he be released from JC immediately. However, the counsel for the complainant objected and stated that the disclosure statement of accused Imran alias Bunty was recorded as per which he was involved in the commission of a crime, and, therefore, he should not be released. The APP and advocate Abdul Gaffar counsel for the accused Imran alias Bunty submitted that the disclosure statement is inadmissible in law by virtue of Sections 23(1) and 23(2) of Bhartiya Sakshya Adhiniyam (BSA) and, therefore, accused Imran alias Bunty be released with immediate effect. "To the utter dismay of this Court, the Investigation Officer (IO) had not taken steps for the release of accused Imran alias Bunty until the filing of the charge sheet, despite knowing about the illegal custody of accused Imran. Accordingly, a copy of this order be sent to the JointCommissioner of Police for the necessary information and action," the ASJ Bansal ordered. The Delhi police charge sheet contains 500 pages. This incident is of March 4, 2026, when a dispute arose after a balloon was allegedly thrown by a minor girl at a woman from a particular community. Thereafter, the relatives of the woman attacked Tarun with sticks near his house. Subsequently, he died the next day due to injuries suffered. During the investigation, it was revealed that the dispute arose after the throwing of a balloon. There was no previous enmity. Police recovered statements of 50 witnesses. (ANI)
