The Delhi High Court on Monday quashed an FIR lodged against businessman Ashneer Grover, and his wife Madhuri Jain Grover for the alleged offences of cheating and forgery.
Justice Chandra Dhari Singh after considering the plea moved by Madhuri Jain Grover and others, quashed the FIR lodged by the Delhi Police Economic Offences Wing (EOW) in 2023. Following this, another bench of Justice Sanjeev Narula directed the Bureau of Immigration to cancel the Look Out Circular (LOC) issued against Ashneer Grover and his wife. Madhuri Jain Grover and others filed a plea seeking the quashing of the FIR lodged under Sections 406, 408, 409, 420, 467, 468, 471, and 120B of the Indian Penal Code (IPC) at the EOW Police Station, New Delhi. It was submitted that the petitioners and the complainant arrived at a settlement on September 30. Senior advocate Mohit Mathur had appeared before Justice Chandra Dhari Singh and submitted on behalf of the petitioners that all the disputes between the complainant M/s Resilient Innovations Private Limited and the accused persons, namely, Madhuri Jain Grover, Ashneer Grover, Deepak Jagdishram Gupta, Shwetank Jain and Suresh Jain have been settled and prayed for some time to file an affidavit regarding the compliance of the terms of the settlement agreement. After the FIR was quashed, the coordinate bench of Justice Sanjeev Narula directed the authorites to cancel the LOC in their records. Ashneer Grover and Madhuri Jain Grover had challenged the order of LOC issuance. Advocate Giriraj Subramanium appeared for Grovers. The High Court was informed that the FIR of EOW, pursuant to which LOC was issued has been quashed by the Delhi High Court today. Justice Narula noted that the Counsel for the parties apprised the Court that the afore-noted FIR has now been quashed through the decision of this Court rendered today. Although the copy of the order is not available as of now, however, the afore-noted fact is not disputed by the counsel for the parties. "In light of the fact that the underlying FIR has been quashed, the LOC issued by the Bureau of Immigration, in the opinion of the Court, would not survive," Justice Sanjeev Narula said in the order passed on November 11. "Accordingly, the present petitions are disposed of with a direction to the Respondents to cancel the LOC against the Petitioners in their records," Justice Narula ordered. Ashneer Grover and his wife had challenged the Look Out Circular issued against them by the Bureau of Immigration at the instance of Delhi Police, Economic Offences Wing in view of the investigation against the Petitioners arising from FIR registered at Police Station, EOW under Sections 406, 408, 409, 420, 467, 468, 471 and 120B IPC.
