Delhi's Tis Hazari Court has taken cognizance of the charge sheet filed in a case related to gang rape with a minor in a moving bus. The victim had boarded the bus from Greater Noida and she was abondoned near ISBT Kashmiri Gate.
An FIR was registered at Police Station Kashmir Gate (Metro). The victim had approached the police to register the FIR. The charge sheet has been filed under Section 6 of POCSO and BNS against the driver and conductor of the bus, namely Kuldeep and Sandeep. It is alleged that they gang-raped the minor who boarded the bus while en route to Delhi from Mainpuri. The charge sheet is around 400 pages and contains statements of 50 Prosecution witnesses and also a forensic report. Special Judge (POCSO) Sonam Gupta took cognizance of the charge sheet on September 24. The charge sheet was filed on September 18. Now the court has listed the matter for arguments on framing of charges against two accused persons, Kuldeep and Sandeep. The next date of hearing is October 7. The matter came to light in August end. However, the police had registered the case before it was highlighted. It is alleged that the bus plied for around 47 kilometres from Greater Noida to Kashmiri Gate. Thereafter, the bus was found by the police team at a parking lot in Timar Pur. Subsequently, both accused were arrested. Police have invoked sections 70(2) (Gang rape of a female under the age of 18), 87 (kidnapping of a woman for illicit intercourse), 127(2) (wrongful confinement), 137(2) (Kidnapping), 3(5) (common intention) of BNS and section 5(g) (penetrative sexual assault on a minor) and 6 (Aggravated penetrative sexual Assault) of POCSO against the accused persons. A 16-year-old student from Uttar Pradesh was allegedly subjected to a brutal gang-rape aboard a moving sleeper bus that travelled nearly 47 kilometres across the national capital region before the suspects abandoned her near a major transit terminal, police said. The incident reportedly occurred on the night of August 4 in a sleeper bus in the Kashmere Gate area. The police have arrested the bus driver, Kuldeep, and the conductor, Sandeep, in connection with the case. (ANI)
