Court dismisses Tahir Hussain's plea seeking statements of a witness in another case

Delhi's Karkardooma court has recently dismissed a plea by former AAP councillor Tahir Hussain seeking production of documents of another case. Tahir Hussain is an accused in larger conspiracy of Delhi riots of 2020.

Husain had moved an application under Section 91 of the Code of Criminal Procedure,1973, seeking production of documents.

Delhi police have charge sheeted several people along with Hussain under the provisions of the Unlawful Activities Prevention (UAPA) Act.

Additional Sessions Judge Sameer Bajpai said in the order that accused Tahir Hussain sought the production of the statements of Rahul Kasana who is witness in another riot and the money laundering case against Husain.

"The record shows that the case is at its initial stage and charges are yet to be framed, and at this stage, no statement as desired by the applicant can be considered. Further, the applicant has even not explained as if the mentioned statement is brought on record at this stage,how the same would help the case of the applicant. Further, after going through the record, the court is of the view that it is not necessary and desirable to call for the statement of the witness as mentioned by the applicant," the judge said in the order.

In its reply, Special Public Prosecutor Amit Prasad stated that the present application is "an attempt to collect documents in the defence of the accused at the stage when even charges have not been framed."

"The record shows that the case is at its initial stage and charges are yet to be framed and at this stage, no statement as desired by the applicant can be considered," the court said in an order passed on June 1.

It further said, "The court is of the view that it is not necessary and desirable to call for the statements of the witness as mentioned by the applicant."

The court said that, keeping in view the overall facts of the case, the court finds no merit in the application at this stage and the same is accordingly dismissed.

Tahir Hussain, Umar Khalid, Sharjeel Imam, Natasha Narwal, Devangana Kalita, Asif Iqbal Tanha, Safoora Zargar, Ishrat Jahan, Meeran Haider, Abdul Khalid Saifi and others are accused in larger Conspiracy of Delhi riots case. (ANI)
