Delhi's Rohini Court has recently dismissed a bail plea of a man accused of cheating of Rs 62 lakh on the pretext of the sale of 16 acres of agricultural land.
While dismissing the bail plea, the court considered the reply filed by the Delhi Police and the fact that a case was against the accused for absconding. Additional Sessions Judge (ASJ) Sushil Kumar dismissed the bail plea of accused Jaiveer alias Jassu on October 29. " Keeping in view of the above discussion as well as facts and circumstances of this case and also considering the seriousness of the offences alleged against the applicant/accused Jaiveer alias Jassu, this court is not inclined to grant bail to the accused at this stage," ASJ Sushil Kumar said in the order dated October 29. The court observed, " In the present case, no recovery of cheat money has taken place to date. Further, the accused was declared absconder on 06.04.2024 as he was evading his arrest and he had absconded. In this case, an FIR was registered at PS Prashant Vihar Under sections. 420,.406, 34, 174A IPC in 2022 with the allegations that the accused has cheated the complainant to the tune of Rs. 62 lakhs on the pretext of selling an agricultural piece of land measuring about 16 acres. The court noted that as per the reply of the Investigation Officer, it has been found during the course of the investigation that accused Jaiveer alias Jassu had also taken byana from one Ajmer with respect to the same property but did not disclose anything about the same to complainant. During the course of arguments, it was stated by the complainant that the accused had also tried to sell the property in question to his neighbours through the registry, but the same was cancelled as there was a stay on the property in question by the Judicial Magistrate. It was also mentioned in the reply filed by the investigation Officer that the accused is also involved in an FIR registered at Police Station Pillukheda, District Jind, Haryana with the allegations that he had entered into an agreement to sell a piece of land to a person who committed suicide when the accused cheated him. Additional Public Prosecutor (APP) strongly opposed the bail application and submitted that allegations against the accused were serious in nature. It is prayed that the application should be dismissed. Counsel for the accused submitted that he has been in Judicial custody since 17.07.2024 and he has been falsely implicated in the present case. It was further submitted that allegations made by the complainant relate to an agreement to sell 16 acres of land, which was entered into on 23.08.2021 between the complainant and the applicant. He further submitted that an amount of Rs. 2,00,000 was given as token money for this agreement and it was clearly communicated by the accused to the complainant that the entire 16 acres of land was not under the exclusive ownership of the accused. It was further submitted that the accused only owns 71 kanals of the total 109 kanals of the land in question and the accused had informed the complainant of issues with his brothers regarding the remaining portion.
