West Bengal Congress leader Soumya Aich Roy has written to Governor CV Ananda Bose, seeking action against Bharatpur MLA Humayun Kabir and Berhampur MP Yusuf Pathan for allegedly polarising voters on religious lines to secure victory in the 2024 general elections.
In a letter dated October 3, Roy said, "Recently, Mr Humayun Kabir, the elected MLA of Bharatpur Constituency of Murshidabad, West Bengal has made a statement on the win of Mr Yusuf Pathan from Berhampur Lok Sabha Constituency in the General Elections 2024. In his statement, Mr Humayun Kabir stated how they polarised the voters on the basis of religion to win in the general elections. His statement caused unrest." "His statement is complete violation of laws and constitution. In Section 196 of The Bharatiya Nyay Sanhita 2023 it is clearly said that promoting enmity between different groups on grounds of religion, race is a punishable offence. Article 19 of the Constitution of India clearly says that Freedom of Speech is restricted when it violates the sovereignty and integrity of India. An elected MLA has to swear that he will uphold the sovereignty and integrity of India, but Mr Humayun Kabir didn't work as per his oath," Congress leader Roy said. "So as a citizen of India, some questions come to my mind, that why Mr Humayun Kabir's membership from the West Bengal Legislative Assembly should not be cancelled and why the election of Berhampur Lok Sabha constituency of 2024 will be declared as void. I will look forward to your kind attention on this matter," the Congress leader stated in the letter. Trinamool Congress leader Pathan Yusuf won from Baharampur parliamentary constituency in the 2024 general elections by securing 524,516 votes. He defeated Congress leader Adhir Ranjan Chowdhury.
