SC reserves order on plea challenging Delhi HC stay order on Khurrana's bail in money laundering case

The Supreme Court on Friday reserved an order on Parvinder Singh Khurana's plea challenging the Delhi High Court order staying his bail order in a money laundering case.

A bench of justices Abhay S Oka and Augustine George Masih reserved the order on Khurrana's plea and observed that a stay-on-bail order by the court should be given in rarest and exceptional cases.

The court also observed that one cannot curtail liberty like such practice as it will be disastrous. The court observed human liberty under Article 21 of the Constitution.

However, Solicitor General Tushar Mehta took the court through cases where people fled to the outside country. He also responded to the court's query on the condition and said that once the person is outside India, no conditions work.

However, the court opined that if a person is a terrorist or involved in multiple cases of anti-nationalist activities or a very perverse bail order then stay on that decision is understood.

With these observations, the court reserved an order on the plea by Parvinder Singh Khurana, an accused in a money laundering case.

Khurana was granted bail by the trial court but his bail order has been stayed by the Delhi High Court.

On June 23 2023, the Delhi High Court stayed the operation of the trial court order dated June 17 2023 till further orders and this order was later extended from time to time.

Khurana approached the top court against the Delhi High Court's decision to prolonging stay on his bail order. On June 7 the top court lifted the stay order of the Delhi High Court. (ANI)
