Court grants custody parole to Gangster Kala Jatheri to perform mother's last rites

Delhi's Patiala House Court on Wednesday granted six hours of custody parole to Gangster Sandeep, alias Kala Jatheri, to attend funerals and to perform last rites of his mother tomorrow at his village, Jatheri, Sonipat, Haryana.

Sandeep's mother died on Wednesday and the funeral is fixed for tomorrow, i.e., July 4.

Additional Sessions Judge Chander Jit Singh Chander Jit Singh granted six hours of custody parole to Kala Jatheri to perform the last rites of his mother and to console the family.

"Having considered the submissions made by Learned Counsel on humanitarian grounds, that considering the accused wants to perform last rites of his mother, namely Kamla Devi, custody parole of accused/applicant Sandeep alias Kala on July 4, 2024, for six hours starting from 11:00 am to 5:00 pm excluding travel time of journey for reaching to the place where final religious rites of the mother of applicant/accused is scheduled to be held at Village Jatheri, District Sonipat, Haryana, is hereby granted, in terms of Rule 1203 of Delhi Prison Rules," the Additional Sessions Judge Chander Jit Singh ordered on Wednesday.

While granting custody parole, the court said that jail authorities and the local police station would ensure that the accused would not go to any other place and would not meet any other person except to participate in the last rites of his mother.

In order to maintain the dignity of the ceremony, the court directed that those police officials who would accompany the accused may not be in police uniform, however, other officials of force who would be ensuring law and order, security, etc. can be in uniform and stay outside the venue.

The court directed the jail superintendent to ensure adequate safety/security measures are taken while taking the accused for custody parole.

Jail authorities have also been directed to coordinate with the local police station to ensure law and order, security, etc., as well as to take appropriate measures to ensure that the accused/applicant may not flee during custody parole.

Advocate Rohit Dalal moved an application on behalf of Kala Jatheri seeking parole to attend the funeral and last rites ceremony of his mother on July 4 in his native village, Jatheri.

His counsel submitted that the mother of Kala Jatheri had expired on July 3. The funeral of the mother of the applicant is fixed for tomorrow, i.e., July 4, and the presence of the applicant/accused, Sandeep alias Kala, is required to conduct the religious rituals of his mother as well as to console the entire family.

The Counsel requested that the applicant be released on custody parole for two hours on July 4.

In March, Sandeep and Anuradha Chaudhary tied the nuptial knot in Delhi under intensive police security cover. (ANI)
