"Option of filing review petition being explored": CPI(M) leader MY Tarigami on SC upholding abrogation of Article 370

CPI(M) leader MY Tarigami on Thursday said that options are being explored including filing a review petition before the Supreme Court in regard to its judgment upholding the Centre's decision to abrogate the Article 370.

The remarks came after a five-judge Constitution bench of the Supreme Court on December 11 unanimously upheld the Union government's 2019 decision to abrogate Article 370 of the Constitution which conferred the special status to Jammu and Kashmir while pointing out that Article 370 is a "temporary provision".

Speaking to ANI, CPI(M) leader MY Tarigami said, "In addition to being a petitioner representing my party, I am also a citizen and as a citizen, I would say I am not happy with the verdict. We are exploring more options, including requesting the court to review the verdict, and restore the rights of the people of J-K."

MY Tarigami further stated that the local citizens of Jammu and Kashmir were not involved in the consultation process by the Centre before abrogating the said article.

"Article 370 became a bridge between Jammu and Kashmir and the rest part of India, it was abrogated without consulting the local citizens. Their views were not taken before taking this decision of abrogation," he said.

The apex court, while upholding the revocation of Article 370 from Jammu and Kashmir in a landmark ruling, set a deadline of September next year for the Centre to restore statehood to Jammu and Kashmir and hold elections there.

CJI Chandrachud, reading out from the judgement, said every decision taken by the Centre on behalf of a State under proclamation can't be subject to a legal challenge and it will lead to the administration of the state to a standstill. The Supreme Court said that Article 370 of the Constitution was only temporary. (ANI)
