NHRC refers complaint to Kar SHRC on Janardhan Reddy's arrest

The National Human Rights Commission (NHRC) has forwarded a complaint filed by an advocate of Andhra Pradesh High Court on the arrest of former Karnataka BJP Minister Gali Janardhan Reddy in the illegal Mining case. The Advocate P Sai Krishna Azad on December 7, 2011, had lodged a complaint with the NHRC through an e-mail and it was placed before the Commission on January 6, 2012 for its addressal. NHRC Assistant Registrar (Law) in a letter to Karnataka SHRC Secretary on February 1 2012 directed that the grievance raised in the complaint related to matter which is subject of the state. Mr Azad told UNI today that he had highlighted in his complaint that the CBI while arresting Mr Janardhan Reddy had not followed the guidelines as given by the Supreme Court in the case of D K Basu vs Union of India. He said in that case, the Apex Court had directed that the competent authority, either CBI or police should follow the principles of Natural Justice. However, the investigating agency had failed to provide the FIR copy to the former BJP Minister. The advocate said the CBI had not given prior intimation to Mr Janardhan Reddy on his arrest and could not produce before the CBI court at Nampally within 24 hours of his arrest, on September 5, 2011. Prior notice had also not been given to Mr Janardhan on seizure of his properties at Bellary, Mr Azad claimed. UNI CS VK AKM RSS1447 NNNN
