Petition in HC against UP govt notification regarding RTI

A writ petition has been filed in the Lucknow bench of the Allahabad High Court today challenging the Uttar Pradesh government notification through which the Vigilance Department and state Vigilance Establishment have been kept out of the purview of the Right to Information Act 2005.
The petition was filed today in the registry section of the High Court by National RTI Forum, convenor Nutun Thakur through her counsel Ashok Pande against the Notification No 2339/39-4-2010- 21/05, of September 22, 2010 issued by UP Principal Secretary, Vigilance.
The notification, passed by the UP government under section 24(4) of the RTI Act states that providing information under RTI was having an adverse effect in the 'process of investigation and prosecution of offenders' and hence was being stopped.
The petition seeking quashing of the notification has urged the court to direct the respondent not to give effect to the Notification till the disposal of the petition.
The petition further says that though section 24(4) of the Act gives power to the State governments to order exemption of certain organisations from the application of this Act but it also clearly mentions that this shall not apply for cases related with allegations of corruption and human rights violations. The petition provides a comparative status of the UP Vigilance department vis-a-vis the Central Vigilance Commission and the Central Bureau of Investigation, which have the same function at the Central government level as Vigilance department has in the State.
