Bar Council of Andhra Pradesh is making efforts with regard to the establishment of Bar Council of Telangana.
In the General Body meeting of Bar Council of Andhra Pradesh held last month, the issue with regard to bifurcation of the Bar Council of Andhra Pradesh came up for consideration, AP Bar Council Chairman A Narasimha Reddy said in a release here today.
After deliberations , The Bar Council decided to a constitute a nine-member sub-committee headed by A.Narasimha Reddy (Chairman).
The Committee which met few days back, after lengthy discussion with regared to the interpretation of relevant provisions under the Andhra Pradesh Re-Organization Act, Advocates Act 1961 and the Bar Council of India Rules, the Sub-Committee felt that certain clarification are to be sought with the Council of India on the issue of constitution of new Bar Council for the state of Telangana, he said.
In this regard, the Committee felt it necessary to go through the previous bifurcations of Bar Council of The State of Bihar and The state of Uttar Pradesh.
The Bar Council of India has also constituted a sub-Committee in this regard and hold a meeting with the Sub-Committee of the Bar Council of AP at the office of Bar Council of India at New Delhi, he said.
In the meeting, the representatives from Bar Council of Chattisgarh and Uttar Pradesh also participated.
In the lengthy meeting, the Bar Council of India(BCI) also expressed its view that it may not be possible to commence a new Bar Council for the state of Telangana, since a separate High Court is not established.
But, Section 34(2) of A.P.Re-organisation Act make provision for the Advocates who are practicing before the High court of judicature at Hyderabad to avail their option of practice within one year from the date of establishment of High court of Andhra Pradesh and the High court of the State of Telangana as mentioned in Sec 31 of the Andhra Pradesh Re-Organisazation Act.
However, the General Body of Bar Council will meet within short period to take necessary steps in this regard, he added. UNI KNR AKM ADB1626
