A Utah man kicked his cousin out of his house, believing he was making the deadly toxin ricin, court papers reveal. The Salt Lake City Tribune reported Wednesday that Thomas Tholen didn't tell authorities about Roger Von Bergendorff's suspected efforts because he feared getting in trouble for other items he stored in his basement, including guns, a detonator cord and blasting caps. Tholen, a 54-year-old free-lance artist, is charged in Utah with knowing a biological agent had been illegally produced and making an untruthful statement to conceal the offense. He entered a not-guilty plea to the charges Tuesday and was allowed to remain free, the newspaper said. Tholen's defense attorney Greg Skordas said his client was cooperative with investigators. He was honest and truthful throughout, Skordas was quoted as saying. Authorities learned about the ricin after Bergendorff was taken to a Las Vegas hospital Feb. 14 in critical condition. His brother, Eric, contacted management at the hotel where Bergendorff was staying Feb. 22 to tell them there was a dog and two cats in the room that probably needed attention, according to court papers.
