SC dismisses appeal of accused providing fund to terror orgn

The Supreme Court has dismissed the appeal of a person accused of providing funds to terrorist organisations in North east challenging the order of the Special Judge extending time for completing investigation by 60 days.

Petitioner Redaul Hussain Khan was arrested along with Mohit Hojai, chief executive member of the North Cachar Hills Autonomous Council, on May 31 from Kamrup in Assam. Mohit, during interrogation, disclosed that he was sending Rs 1 crore to an organisation called DHD (J), an extremist organisation for purchasing arms and ammunition. He also revealed that he had collected Rs 30 lakh from Khan.

The investigation was taken over by National Investigating Agency (NIA) and Union Home Ministry banned DHD (J) under the Prevention of (Unlawful Activities) ACT, 1967.

Special Judge, Kamrup extended on August 28, 2009 the period for completion of investigation by a further period of 60 days under section 43D (2 (b)) of the Act.

The Guwahati High Court dismissed the appeal of the petitioner against the trial court order granting more time to NIA to complete the investigation on September 19.

A Bench comprising Mr Justice Altamas Kabir and Mr Justice Cyriac Joseph while dismissing the appeal noted '' merely because DHD (J) had not been declared as an unlawful association, when the petioner was arrested, the said organisation could not have indulged in terrorist act or that the petitioner could not have had knowledge of such activities, is not acceptable to us.'' The Apex Court also rejected the plea of the petitioner for bail and held that the Sessions Judge had the jurisdiction to extend the time for completion of the investigation. It also noted that the recovery of Rs four lakh from the petitioner would require further investigation.
