HC stays demolition in Chhawla village

The Delhi High Court has issued notices to the MCD, Public Grievances Commission (PGC) and Deputy Commissioner of Police over demolition of houses at Chhawla village in South West district.

A vacation bench of Judge Mukta Gupta also restrained the MCD from demolishing about five houses at village Chhawla in South West Delhi till further orders.

The Judge asked the agencies to explain how they can demolish houses which are built on plots which were alloted to the residents after consolidation proceedings in the village.

Hearing a bunch of petitions filed by the residents of the village, who alleged that their houses are being wrongfully put on demolition list as it is another plot which comes in the way of widening of a road.

As houses are built on plots which were alloted to them after duly carried consolidation (chak-bandi) proceedings, Judge Mukta Gupta said since no notice was given to the residents for demolition, the proceedings should be stayed till the next date of hearing.

The petitioners alleged that the Public Grievances Commission without hearing them, directed the BDO of South West district and Revenue Department to make a joint encroachment removal action. Lawyers S K Rout, M K Pradhan and Tarun Diwan appearing for the petitioners, said the PGC wrongfully directed the authorities to remove the residents from there as it was not the competent authority to do so.

The PGC was not competent authority to order a demolition. If any anti-demolition drive has to be carried out it has to be through a court order, Mr Tarun said.
