HC restrains Punjab from allotting houses of riot victims

The Punjab and Haryana High Court today restrained the Punjab government from allotting or selling 85 low income group (LIG) houses lying vacant in Dugri Road urban estate, Ludhiana which were claimed to be built for allotment to the riot victims. An order to this effect was issued by the division bench of the Acting Chief Justice Jagdish Singh Khehar and Justice Ajay Kumar Mittal after the preliminary hearing on the PIL preferred by Ludhiana-based Danga Peedit Welfare Society (regd). The bench has also issued notices for November 30 to the state chief minister, the chief secretary, relief and rehabilitation department secretary and Mohali-based chief administrator, PUDA asking them to file the response to the contents of the petition. It was contended by advocate Vikram Bali, counsel for the petitioner, that despite a decision having been taken at the highest level after a meeting between the state chief minister and the society representatives in 2001 to earmark these houses to the riot affected families, the allotment was being denied by the authorities on the ground that this was not included in the State Cabinet decisions of October 21, 2008 and December 2, 2008. The counsel pointed out that for allotting these LIG houses to the riot affected families, the state government had invited applications which were duly scrutinized by the screening committees constituted for this purpose only, interviews of the applicants were held and now only the result of the same remained to be notified and allotment letters were to be issued. The committee in its PIL has annexed copies of the decisions taken in this regard previously and the houses built at various places as a measure of relief to the riot victims. There are 85 houses still lying vacant and the petitioner apprehends that the authorities might allot the same to persons other than the riot victims, hence the plea for judicial intervention.
