India Guj HC orders reinstatement of judge dismissed on corruption charges
The Gujarat High Court has ordered reinstatement of an Additional Sessions Judge after ten years of dismissal on corruption charges and directed the High Court registry to pay Rs 15,000 as legal expenses to the judge. A division bench comprising Chief Justice K S Radhakrishnan and Judge Anant Dave, in an order yesterday, directed reinstatement of Mr S J Pathak with all service benefits like entitlement of 50 per cent of the salary for the last ten years. Mr Pathak, then Additional Sessions Judge at Godhra, was initially suspended in 1999 and later dismissed by the High Court in 2006 on alleged charge of corrupt practices and amassing wealth. Mr Pathak, in his writ petition, questioned the working style of the High Court Vigilance Department contending that disciplinary action had been taken against him on baseless oral complaints apparently by his rival judges and advocates. ''Even the Supreme Court had held that in every case the situation is different and same punishment cannot be given in each case'', Mr Pathak said, alleging bias against the court's vigilance department. -- (UNI) -- 07BY2.xml
